TO THE EXTENT PERMITTED BY LAW, DDAS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PRODUCTION, REVENUE OR DATA, OR FOR DAMAGES CAUSED BY MISUSE OR INCORRECT INTEGRATION.
DDAS’S TOTAL LIABILITY ARISING FROM OR RELATED TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER.

All software is provided “as-is” without warranties of any kind. The customer is responsible for testing, validating, and verifying the correct functionality of the software before use in any production environment.

14. Special Terms: CRA Compliance Service
Scope. Each order covers one standard CODESYS-based PLC program. Additional software, dashboards, backend modules, edge software or other non-standard setups require a pre-assessment by DDAS; DDAS may decline such an order and will then refund the price paid. A follow-up run applies only to a new software version of a product already analysed by DDAS. The Classification & DoC add-on can only be ordered together with a run.
Your role as manufacturer. You remain the manufacturer within the meaning of Regulation (EU) 2024/2847 (Cyber Resilience Act). You decide the product boundary and the CRA product class, you issue and sign the EU Declaration of Conformity, and you place the product on the market. DDAS provides analysis, software tools, a defined process and predefined text modules with source references. DDAS does not provide legal advice, does not act as a notified body and does not certify conformity. Checks performed by DDAS or its tools are plausibility and completeness checks, not an approval.
Your obligations. You provide complete and accurate project data and are entitled to share it with DDAS. Results reflect the data provided and the vulnerability information available on the date of analysis. DDAS does not guarantee that all vulnerabilities are identified.
Delivery. The service is delivered remotely only: through an access code to the DDAS CRA Wizard and a handover package signed by DDAS. DDAS aims to deliver within 10 business days after receiving complete project data, including the completed Classification Paper where the add-on is booked. If DDAS expects a longer period, it will inform you before starting. Documents are produced in the language chosen at the start (German or English). Any change to the signed handover package invalidates the signature.
Not included. Remediation of vulnerabilities; further product variants (ordered as follow-up runs); work beyond a standard CODESYS-based PLC program unless agreed in writing.
Confidentiality. DDAS treats your project data and everything derived from it (SBOMs, findings, risk reports and the handover package) as confidential and uses it only to deliver the service. DDAS does not use it for other customers, for its own products or for marketing, does not use it to train AI models and does not upload it to online analysis or AI services. DDAS reports vulnerabilities found in your product only to you and does not pass them on to third parties, including component suppliers or authorities, without your consent unless the law requires it. Only persons who need access for the service and are bound to confidentiality have access. If you need a signed non-disclosure agreement, DDAS provides its template on request or reviews yours.
Data exchange and processing. You upload project data through a time-limited link, valid for at most seven days, to non-public storage at Cloudflare with EU data location; if your IT requires another channel, DDAS collects the data from a platform you provide. Project data is not exchanged by email. DDAS analyses it on access-protected workstations with encrypted storage outside the EEA. Cloudflare, Inc. is the only subcontractor that stores project data. If DDAS becomes aware that project data has been lost or disclosed without authorisation, it informs you without undue delay and in any case within 72 hours. A data processing addendum with the EU Standard Contractual Clauses is available on request.
Data retention. Files in the exchange storage are deleted automatically 30 days after upload; please download the handover package within this period. All other copies of your project data are deleted no later than 30 days after delivery of the handover package; DDAS keeps no backups of project data and no copy of the handover package. DDAS keeps an order record (company, contact, order number, product, version, date, package, the hash of the signed manifest and the tool version) for no longer than ten years after the order, to verify follow-up runs, to revoke signatures and to inform you if an error in its tools affects your results. You are responsible for archiving the handover package as part of your technical documentation (Art. 13(13) CRA); DDAS cannot re-issue a lost package.
Refunds. Full refund before the first upload of project data, or if DDAS declines the order after a pre-assessment. No refund once the analysis has started.
